Terms of Service

These Terms of Service ("Terms") govern your purchase and use of products and services offered by LobsterKit ("we", "us", or "our") through lobsterkit.sh (the "Site"). By purchasing any product or accessing the Site, you agree to be bound by these Terms.
1. Products
LobsterKit offers the following products:
- The Guide — A digital PDF guide ($29, one-time payment)
- LobsterKit — A pre-configured Raspberry Pi 5 hardware kit ($500, pre-order)
2. Pre-Orders
LobsterKit hardware is sold on a pre-order basis. By placing a pre-order, you acknowledge that:
- Your payment is collected at the time of order
- Estimated shipping time is within 15 business days, but this is not guaranteed
- Delivery timelines may vary due to supply chain availability
- Pre-orders are non-refundable and non-cancellable once placed
3. All Sales Final
ALL SALES ARE FINAL. We do not offer refunds, returns, exchanges, or credits for any products, whether digital or physical. Please review our Refund Policy for complete details.
4. No Warranties
All products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The products will meet your specific requirements
- The products will be uninterrupted, timely, secure, or error-free
- The results obtained from the products will be accurate or reliable
- Any defects in the products will be corrected
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOBSTERKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use our products
- Any unauthorized access to or use of our products
- Any third-party software, including OpenClaw
- Any hardware failure or malfunction
Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.
6. Third-Party Software and Hardware
LobsterKit is not affiliated with, endorsed by, or associated with the OpenClaw project, Raspberry Pi Ltd, Anthropic, or OpenAI. All trademarks belong to their respective owners.
We pre-install open-source software (OpenClaw) on hardware manufactured by third parties (Raspberry Pi). We are not responsible for bugs, vulnerabilities, or changes in third-party software or hardware.
7. API Keys and Third-Party Services
Use of LobsterKit requires an API key from a third-party AI provider (e.g., Anthropic, OpenAI). You are solely responsible for:
- Obtaining and maintaining your own API key
- All costs associated with API usage
- Compliance with the API provider's terms of service
- Securing your API key
8. Documentation Access
Documentation access is provided via an access code included with your purchase. This access code is for your personal use only and may not be shared, redistributed, or published.
9. Intellectual Property
The Guide, documentation, website content, and branding are the intellectual property of LobsterKit. You may not reproduce, distribute, or create derivative works without our written permission.
10. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. Your continued use of our products after changes constitutes acceptance of the modified Terms.
